We understand the profound impact divorce can have on individuals and families. Our firm provides compassionate guidance throughout the divorce process, whether it is contested or uncontested.

Every Divorce in Little Rock Is Unique

Divorce is a legal process that terminates a marriage, addressing issues such as asset division, spousal support, and child custody. There are two primary types of divorce:

Contested Divorce:

In a contested divorce, spouses are unable to reach agreements on critical issues, leading to litigation. With more than 80 years of combined experience and top attorney awards from the Arkansas Times and others, you can rely on our attorneys’s legal expertise in negotiations and in court. While we’re “the firm with a smile” when we’re with you, when it comes to the opposing side, we’re an intimidating force to reckon with. You’ll be glad to have us in your corner.

We provide comprehensive legal representation, addressing complex matters such as:

  • Asset division: Ensuring fair and equitable distribution of marital assets.
  • Child custody: Protecting parental rights and promoting the best interests of the child.
  • Spousal support: Securing fair and just financial support for spouses.

Uncontested Divorce:

In an uncontested divorce, spouses agree on all major issues, streamlining the process and minimizing conflict. While less contentious, it is still very important to seek reputable legal guidance to ensure your rights are protected. Even if you and your former partner see eye-to-eye on every issue, having an attorney on your side can only protect your interests.

Our attorneys provide comprehensive support in uncontested divorces, including:

  • Drafting divorce agreements: Crafting detailed agreements that address all aspects of the divorce.
  • Legal guidance: Providing advice and counsel to ensure clients' interests are safeguarded.
  • Document preparation: Assisting with the preparation and filing of necessary paperwork to finalize the divorce.

The Miller & Mallett legal team prioritizes efficiency and clarity in uncontested divorces, guiding clients through the process with care.

How long does a divorce usually take in Arkansas?

The timeline depends on whether the divorce is contested. Uncontested divorces can move forward relatively quickly, while contested matters—especially those involving children, property, or financial issues—often take several months or longer. The Law Offices of Miller & Mallett help clients understand what to expect and work to keep the process moving efficiently.

Do I have to appear in court for my divorce?

Not always. If both parties reach an agreement on all major issues, the court appearances may be minimal. When disputes need to be resolved, hearings are more likely. Our team works to settle matters through negotiation whenever possible, reducing the need for extensive court involvement.

How is property divided during a divorce?

Arkansas follows an equitable distribution system, meaning assets and debts are divided fairly—but not always equally. Generally, marital property is divided 50/50, but not always. Courts may look at factors such as each spouse’s income, contributions to the marriage, and long-term financial circumstances. We help clients prepare a clear picture of their property and advocate for an arrangement that protects their interests.

What documents will I need to provide during the divorce?

You’ll be asked to gather financial records, bank statements, tax returns, property information, insurance documents, and details about debts. Full disclosure is required so both sides can reach a fair resolution. Our attorneys guide clients on what to collect and help organize the information to avoid delays.

Can I continue living in the marital home during the divorce?

In many cases, yes. Whether one spouse remains in the home depends on financial practicality, personal safety, and the family's needs. Temporary agreements or court orders can be established to clarify responsibilities while the divorce is pending.

What happens if my spouse refuses to cooperate with the divorce?

A divorce can still move forward even if one spouse is uncooperative. Arkansas law provides procedures for situations where a spouse fails to respond to filings, misses deadlines, or refuses to participate in the process. Our attorneys step in to ensure the case continues, protect your rights, and prevent unnecessary delays.

What are your fees?

An in-person consultation for a divorce is $200 which is applied to a flat fee or retainer fee if we are hired for your case. For uncontested divorces with no children, we have a flat fee of $1,250.00. For uncontested divorces with children, our fee is $2,500.00. If a divorce is contested, we require a $5,000.00 retainer that will be billed against hourly. If the retainer runs out, it will need to be refreshed. If we do not bill the full $5,000.00, the remaining balance is returned to you.
